Can i file a complaint in comsumer court aganist a person who has done fraud in a real estate transaction with me and not refunding my money paid on agreement?

No if he is single individual. If he is real-estate company then yes since you're his consumer.

Also you can file FIR with Police under various sections of IPC for cheating, fraud etc using these sections:

Cheating : IPC 420
Mischief : IPC 425
Perjury : 191
