development. Accused Rakesh Khatana and B.K.Mishra are the parsons who gave false title reports and false legal reports in respect to
the project land. In September/October 2012 the above Accused Naresh Sabharwal and Jeevesh Sabharwal, Directors of Horizon
Buildcon Pvt,Ltd. came to me and told me that they have entered into a collaboration Agreement dated 28.08.2012 registered with sub registrar, Amritsar falling within the revenue estate of village. The accused persons represented to me that by virtue of said collaboration agreement they are fully entitled as absolute owners and hence undertaking ‘the developmentand
construction ofa multistoried group housing residential apartments. It was also represented by the accused persons that their company
Horizon Buildcon Private Limited is fully competent ana absolutely free to prepare the building plans, layouts interiors
etc, to determine price of the flats and such- other acts as and when required, to allot and issue the allotment letter to prospective buyers
and execute the agreement to sell and can act as rightful owner of the said land. In order to inauce me to erter into ‘Marketing Agreement’
for the proposed project Accused persons shown. Me a verificatian title report dated 01.10.2012 prepared by Accused. №5 Rakesh
Khatana ac per which there was nc dispute or Gave notification or encumbrance of any kind whatsoever on the said land.
Jeevesh Sabharwal floated a project by the name of ‘IRIDIA’ on the abovesaid land in which the construction was to be done by their company i.e.Horizon.
buildcon Private Ltd, Accused No 4. In order to take further money from me Accused Persons made represented that the project is coming up at the land which is freehold property instead of leasehold property from NOIDA Authority, that the project was clear of all
encumbrances, had been obtained and further represented that the project would be delivered on time with top quality construction. The
Jeevesh Sabhrwal and Naresh Sabharwal also represented that major in November. 2015 again assured National Banks & financial institutions (like SBI
and Punjab and Sind Bank) have approved their project. | and various home buyers were also shown many approvals from Zila
Panchayat and other authorities on this project in order to take more money from us. They also showed a sanctioned letter which was
purported to be issued by Noida Development Authority. On
23/09/2014 Noida Authority pasted a Notice on the project site stating that the IRIDIA’s project construction is illegal. Upon reading the
said Notice | was shocked to know that the Jeevesh Sabharwal were constructing the said project in violation of the Master plan and had not
obtained approvals from the Local authorities .
It is clear that the Rakesh Khatana and B.K. Mishra who are working with Jeevesh sabharwal,Naresh Sabharwal and Ambika Sharma in conspiracy with other Persons prepared false reports in order to defraud and public at large. When confronted the same from Jeevesh Sabharwal,these litigations and fraud committed by Jeevesh Sabharwal.
