Clarification of Provisions of RERA Act, 2016

Subject : Clarification on Circular no. 25/2019 dated 11/10/2019 issued by the Maharashtra Real Estate Regulatory Authority

Respected Sir/Madam,

This Letter is with reference to some of the provisions of the Real Estate Regulation and Development Authority Act, 2016 which has been mentioned in the Circular no. 25/2019, and bearing No. MahaRERA /Secy / File No. 27 /1004 dated 11/10/2019. However, I would like you to answer a few of my queries based on the said circular:

1. Whether the said RERA Act is applicable to the open land which can be agricultural or industrial or residential etc.?
2. Whether RERA Registration is required for sale/ transfer of an open land or a part out of the total land, be it agricultural or industrial or residential etc., without any commitment thereto of any construction or amenities thereon owned by an individual or a partnership firm or a company to any potential client by and through Agreement to Sale or Sale Deed or any other transfer deed?
3. If the abovementioned queries do come under the provisions of the RERA Act, 2016 kindly elaborate the sections along with the clauses which support the same.
