Great inconvenience by Finance company

#1
We approach a Finance company because of a reason. It is their job to help us out, which they probably do - but keep on reminding us that we are at their mercy because they have lent money to us.
My father bought a commercial vehicle and approached a finance company for help. My father agreed to pay back the money in EMIs for 1 year. He gave them post-dated cheques for a year (Nov '12-Oct '13) hoping that it would be taken care of. However, out of the blue, the company called on January 15 '13 and said that they hadn't received payment from us for the months of Nov '12 and Jan '13. My father has kept a record of all the cheques he had given and their numbers too. The Finance company then told us they don't have the cheques for those two months and if we don't pay, they will send us a notice. They have been calling us everyday, and we responded that we are ready to pay the money if they show us their records about our cheques. How can we just let it go when we are sure they have misplaced our cheques and still making us pay for it? And why didn't they inform us earlier about the NOv'12 payment? It is very frustrating as we are reminded again and again that we have to pay a penalty for late payment. We want to know what happened to our cheques. They conveniently told us they will show us the records if we bring the payment with us. Sort of a barter deal. Show us the money and we will give you answers about what happened to your cheques. They are not customer-oriented at all.
Please suggest me as to what can be done in this case.
ANy help would be greatly appreciated.

It is a small issue. Place a stop on the cheques( each will cost some Rs. 100, and series will cost little more). You can stop those cheques from your net banking account.

Issue them a fresh set of cheques. It is common, management problem. I don't want to blame them. What does it cost you to stop and issue fresh cheques?
