Dr. Prabir Pal Ultrasonography Bhopal

I was having severe abdomen pain and was referred to Dr. Prabir Pal for ultrasonography by Dr. R P Patel on 23/11/2012.

Ultra sonography was conducted on 23/11/2012 at around 7 PM, in which it was stated that "Right iliac fossa showing mildly inflammed non-compressible hypoechoic appendix with increased wall thickness (9mm). Minimal fluid seen in periappendicular region."

IMPRESSION- Features suggestive of- Acute Appendicitis with free fluid (perforations).

For further treatment I was reffered to Dr. Shekhar Shrivastav, where treatment for Appendicitis started and was to be operated the next day for it via laproscopy.

When they inserted the tools for operation it was found that appendicitis was normal and there was a tubal abortion in right fallopian tube.

Dr. Shekhar during discussions had said that "Even I was wondering that the pain was not around the area where appendicitis is". Still based on the report he carried on with treatment for appendicitis.

I seek advice on two counts,
1) What action can be taken against Dr. Prabir Pal for faulty report?

2) Is Dr. Shekhar also guilty? and action can be initiated against him or not?

First I want to ask if Ultra sonography report was correct? If it was, then have you checked this report with any other specialist about the Acute Appendicits impression it shows?

They attach screen-shots of ultra-sonography with the impression report which Dr. R P Patel and Dr. Shekhar Srivastav should have verified.

Secondly "Features suggestive of- Acute Appendicitis with free fluid (perforations)." impression only suggests rather than confirming the problem. It is the duty of Dr. R P Patel and Dr. Shekhar Srivastav who should confirm this problem before surgery.

First pl. answer these.

Minutes after the ultra sonography i was admitted to the hospital of Dr. Shekhar Srivastav, where based on the report, medicines for appendicitis were given to me and operation date of next day, that is 24/11/2012 was given. I haven't checked the report with any other specialist, Dr. Srivastav, informed my husband during the operation that appendicitis was absolutely normal, so i "believe" that the report was incorrect.

Clearly it is case of negligence and you should ask for good compensation. But you need to find who is responsible for this first.

All three of the doctors are linked to each other, but the role of Dr. RP Patel was limited to sending for ultrasonography and to the surgeon.

Now the onus lies on Dr. Pal first for a faulty test report, and than on Dr Shekhar, who without ascertaining the facts went with the test reports.

How to go about it, also, the amount of compensation is not important, i want the doctors to be more responsible while dealing with the patients and set a precedent.

Please suggest!

Asking for compensation hurts their image and that's the right way to seek justice legally. That's all you can do. You can complain no one for human mistake or if a doctor has low IQ.

Dear Querist,

In the given facts, you may approach State Medical Council and file statutory complaint to SMC for a thorough inquiry in the matter and for their judicious action, with a copy to MCI. Wait for some reasonable days, if no reply come from SMC, you may start using RTI for the update. You will get better result.

Trust this would suffice.
